I am writing to keep you up to date with an important piece
of new legislation that is about to come into effect and will affect all
private rented properties. From The 1st October 2008, all properties that are offered for rent are
required by this new law to have an Energy Performance Certificate (EPC). An EPC entails the property in question being inspected by
an Accredited Domestic Energy Assessor who will assess the age, construction
and location of the property as well as its current fittings such as heating
systems, insulation, double glazing etc. They will then issue a certificate and
give the property a rating from A-G depending how energy efficient the property
is (where A is the most efficient and G the least efficient). Current running
costs for heating, hot water and lighting will also be shown on the
certificate, together with a list of recommended energy saving improvement. The
certificate would then be available for viewing by any prospective tenants.
The government is introducing these certificates in an
attempt to make buildings more energy efficient. These new measures are being
applied across all European Union countries as per the European Directive for
the Energy Performance of Buildings. According to the current guidance on this legislation, this
certificate MUST be in place before the property can be marketed and before any
prospective tenant can view the property.
Landlords who have existing tenant will not require a
certificate until the existing tenant leaves and a new tenant is sought.
However, in view of the fact these EPCs are valid for
10 years and as the current guidance on this matter is that the property would
not be able to be advertised until a certificate is in place, it is advisable
to obtain one as early as possible to avoid any unnecessary delays if the
property was to become vacant.
